Abstract

ABSTRAK DIDIN SUMASYHARI, NIM: 11.21.11.005, “E-COMMERCE CONSUMERS PROTECTION IN LAZADA.CO.ID REVIEW ON ISLAMIC ECONOMIC LAW AND POSITIVE LAW” Transactions or business through cyberspace and the internet known as electronic commerce or e-commerce, had been long known in Indonesia. In addition to the advantages there are also minus in the system of e-commerce. E- commerce consumer more often are in a weak position. Consumer protection needs special attention, especially on legal certainty for consumer e-commerce. Lazada.co.id is a branch of e-commerce lazada group in Indonesia since 2012. Lazada.co.id an e-commerece shaped retail and marketplace. There are some cases that occurred in lazada.co.id consumers, namely: Default, unilateral cancellation, difficultly complain, Piercing lazada.co.id account. Basically Lazada.co.id has made efforts to protect consumers through the rules specified in the standard contracts such as, rules of returns, refund, granting vouchers, consumer complaints service via live chat on working hours and via e-mail directly to lazada. So the rules, standard contracts and terms, conditions of use on lazada.co.id need to be reviewed through the rule of law and positive law of Islamic economics in Indonesia. This study is a literature study (library research), by examining the regulatory documents lazada.co.id raw and to collect data from the basics rules of consumer protection laws of Islamic economics and fundamentals of the rule of positive law in Indonesia. The study concluded that lazada has set consumer protection through regulation and their standard contract terms and conditions (Terms of Use) the use or sale of lazada. Lazada consumer protection under legal review of Islamic economics has been appropriate, as there is a concept khiyar. Settlement of disputes stipulated in the standard contract, lazada also have appropriate consumer protection lazada according to the positive legal review some have appropriate legislation, such as providing clarity of information for consumers in lazada platform. There are other rules that the majority is still not appropriate, such as the implementation of the refund (refund) and the product (return) is not appropriate; burdensome consumer dispute resolution; lazada voucher as compensation, not necessarily in accordance with the will of the consumer; occur unilateral cancellation by the seller, limitation of liability lazada the consumer loss.
